Canberra busker Wallace Quoibia refused bail over alleged rape of intellectually impaired woman

Wallace Nya Quoibia, 54, appeared in the ACT Magistrates Court on Saturday, when he was formally charged with engaging in sexual intercourse without consent. He did not enter a plea.

In court documents, police say Mr Quoibia's alleged victim went with her cousin to Mooseheads in Civic last Saturday night.

She had already had a number of alcoholic drinks, and she remembers sitting beside a fireplace while drinking more in the nightclub.

"[The woman] has no further memory of the evening," the police documents state.

"The next thing she remembers is waking up briefly in a bed with a man on top of her having sex."

Police allege that man was Mr Quoibia, who lives at Ainslie Village in Campbell.

According to investigators, he later introduced himself to the woman as Wallace and told her he had found her, passed out, in a park.

"He said multiple times he couldn't leave her there," police allege.

"Wallace also said that he loved her."

Mr Quoibia is said to have subsequently driven the woman, who has been diagnosed with an intellectual impairment, to the home of one of her relatives.

A few days later, the alleged victim spoke to her cousin about the night in question.

The cousin told her they were walking back to her apartment after leaving Mooseheads when the alleged victim "disappeared" in Glebe Park and they were separated.

The alleged victim participated in an interview with police on Thursday.

Investigators subsequently executed a search warrant at Mr Quoibia's home and spoke to him about the rape allegation.

Over the course of more than two hours on Friday, according to police, he gave his version of events.

This is said to have included that he was walking home after busking outside Mooseheads when he heard the alleged victim "swearing and cursing" in Glebe Park.

Mr Quoibia claimed to have helped her off the ground and hailed a taxi to take her back to his place because "he thought he could not leave her there".

He said that once they arrived, she tried to kiss him but he told her to sleep while he played a game on his mobile phone until she woke up.

Mr Quoibia told police he did not have sexual intercourse with the woman and that "if anyone was sexually assaulted, it was him".

He said he thought she had only made allegations against him because there was a rumour going around Canberra about him being a rapist and a paedophile.

When Mr Quoibia appeared in court on Saturday, prosecutor Sam Bargwanna said it appeared the man had been wanted by Queensland Police on outstanding warrants since 2017.

Mr Bargwanna opposed bail, saying it was likely Mr Quoibia would commit further offences and fail to appear in court when required if he was released.

The 54-year-old musician applied for bail, however, with Legal Aid duty lawyer Hugh Jorgensen arguing conditions could be put in place to "cure" these concerns.

Magistrate Peter Morrison did not agree, noting the outstanding warrants in Queensland related to allegations of "sex-related offending" that dated back to 2008.

He remanded Mr Quoibia, whom the court heard was a father of 11, in custody until the case returns to court on January 14.
